NAV Drone: what you really need to understand before using it (per NAV CANADA / Unifly terms of use)

NAV Drone is a key tool for pilots in Canada, but its legal framework is strict. Liability, $50 cap, indemnification, data ownership: the essentials.

NAV Drone is now a central tool for many drone pilots in Canada. Behind this official NAV CANADA platform, however, lies a strict legal framework that is often poorly understood by users. Here is what you really need to know.

An information tool, not a flight authorization

NAV CANADA is very clear: NAV Drone does not replace any regulatory obligation. The user remains fully responsible for complying with the CARs Part IX, NOTAMs, the AIP and official aeronautical information, and any applicable local/provincial/federal requirements. Even if the application indicates that an area appears open, this does not guarantee the legality or safety of the flight. In addition, the application does not provide any detect-and-avoid (DAA) capability, any aircraft separation/spacing service, and cannot prevent or restrict a flight even if a situation is dangerous.

Responsibility rests entirely with the pilot

The pilot is solely responsible for safety and navigation, airspace access authorizations and requirements, weather and flight preparation, regulatory compliance, and the insurance required for their operations. NAV CANADA also states that the application does not provide any legal or operational advice.

A very strict limitation of liability

In the event of a problem, the maximum liability of NAV CANADA and Unifly is limited to $50 CAD, regardless of the nature of the damage. And no claim may seek indirect, consequential, financial, or special, exemplary or punitive damages.

An indemnification obligation on the user

The user agrees to defend and indemnify NAV CANADA against any claim related to access to the application, use of or reliance on the application, violation of the terms of use, or violation of applicable laws or third-party rights—including reasonable legal fees. In other words: if an incident occurs, NAV CANADA protects itself contractually, and the user may have to cover the costs.

Flight data does not belong to you

The terms state that all information collected and generated by the application (including flight logs and operational data) remains the exclusive property of NAV CANADA. This data may be used for RPAS flight administration, application improvement, incident-related investigations, and sharing with third parties (including government and regulatory authorities). It is also specified that certain information (e.g. identity, pilot certificate, registration) may be shared with Transport Canada for validation.

Suspension or termination without notice

NAV CANADA may suspend or terminate access to NAV Drone for non-compliance with the terms, at any time sometimes without notice, and without any obligation to compensate. Upon termination, the user loses their usage rights and must delete the application.

These terms of use govern all use of the NAV Drone platform (web and mobile applications) provided by NAV CANADA. By downloading, installing or using the application, you agree to be legally bound by these terms. NAV CANADA states that use of the application in no way reduces, removes, exempts or limits the liability of the owner, operator or pilot of a remotely piloted aircraft (RPA): compliance with CARs Part IX, NOTAMs and the AIP; safety and navigation of the RPA; obtaining a valid pilot certificate and required authorizations before any flight. The application is provided "as is" for information only. NAV CANADA's and Unifly's total liability will not exceed $50 CAD. The user agrees to defend and indemnify NAV CANADA against any claim related to their use of the application. Data collected by the application remains the exclusive property of NAV CANADA.
